Privacy Policy
Prevail Transaction Partners ("Prevail," "we," "us," or "our") respects the privacy of everyone who visits prevailprtnrs.com (the "Site"). Much of what people share with us is sensitive by nature — an owner exploring a sale is often doing so quietly, before employees, customers, or competitors know anything about it. We take that seriously. This policy explains what we collect, why, and what you can do about it.
By using the Site, you agree to this policy. If you do not agree, please do not use the Site.
1. Information We Collect
Information you give us
When you fill out a contact form, request a valuation or consultation, complete a questionnaire, subscribe to our emails, or otherwise reach out, you may provide:
- Name, email address, phone number, and mailing address
- Your company name, industry, location, and role
- Business information you choose to share — revenue, earnings, ownership structure, timeline, and goals for a potential transaction
- Any other information you include in your message
Information collected automatically
Like most websites, ours collects certain technical information when you visit:
- IP address and general location (city or region level)
- Browser type, device type, and operating system
- Pages viewed, time on page, links clicked, and the site or ad that referred you
- Cookie and similar identifiers
Information from third parties
We may receive your contact details from a referral source — a CPA, attorney, wealth advisor, or another professional who thought we could help you — or from the advertising and analytics platforms we use.
We do not intentionally collect sensitive personal information such as Social Security numbers, financial account numbers, or health information through the Site. Please do not send that information through our web forms.
2. Cookies and Tracking Technologies
We use cookies and similar technologies for three purposes:
- Making the Site work — page loading, security, and basic functionality.
- Understanding how people find and use the Site so we can improve it. We use Google Analytics for this.
- We use advertising and retargeting technologies (such as the LinkedIn Insight Tag, Meta Pixel, and Google Ads tags) that let us show relevant ads to people who have visited the Site and measure whether those ads work.
You can control cookies through your browser settings — most browsers let you refuse or delete them. Blocking cookies may affect how parts of the Site function. You can also opt out of interest-based advertising through the platforms directly (Google Ads Settings, LinkedIn ad preferences, Meta ad preferences) or through industry tools such as the Digital Advertising Alliance at optout.aboutads.info.
Do Not Track and Global Privacy Control. Our Site does not currently respond to browser "Do Not Track" signals. We do honor Global Privacy Control (GPC) signals where required by applicable law.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiry and communicate with you about a potential engagement
- Provide our advisory services, including preparing valuations, analyses, and marketing materials for a transaction
- Send emails, newsletters, and market updates you have asked to receive
- Operate, improve, and secure the Site
- Measure and improve our marketing, including advertising performance
- Comply with legal obligations and enforce our agreements
4. Confidentiality of Business Information
Business information an owner shares with us — financials, ownership details, or the simple fact that a sale is being considered — is treated as confidential. We use it only to evaluate and advise on a potential engagement or transaction.
We do not disclose a client’s or prospective client’s identity or business information to buyers or other third parties without permission, and when we take a business to market we do so under confidentiality agreements with prospective buyers.
If we work together, the terms of our engagement agreement govern confidentiality, and those terms control if they conflict with anything in this policy.
5. How We Share Information
We do not sell your personal information for money. We share information only in these situations:
- Service providers. Companies that help us operate — website hosting, email and CRM platforms, analytics, e-signature, cloud storage, and similar vendors. They may use your information only to perform services for us.
- Advertising and analytics partners. As described in Section 2, these platforms receive certain Site-usage information through cookies and pixels. Under some state privacy laws, this kind of sharing for targeted advertising is treated as a "sale" or "sharing" of personal information. You can opt out — see Section 7.
- Professional advisors. Our attorneys, accountants, and insurers, as needed.
- In connection with an engagement. If you become a client, we share information as needed to run your transaction — with buyers under confidentiality agreements, and with your attorneys, CPAs, lenders, and other advisors, as directed by you.
- Legal requirements. When required by law, subpoena, or court order, or to protect our rights, safety, or property.
- Business transfers. If Prevail is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
6. Email Communications
If you subscribe to our emails or become a client, we may send you market updates, insights, and firm news. Every marketing email includes an unsubscribe link, and you can opt out at any time by clicking it or emailing us at the address in Section 13. We will still send you emails necessary to an active engagement.
7. Your Privacy Choices and Rights
Depending on where you live, you may have the right to:
- Know what personal information we have collected about you
- Request a copy of that information
- Correct inaccurate information
- Request deletion of your information
- Opt out of targeted advertising, or of the "sale" or "sharing" of your personal information
- Appeal a denial of any of these requests
To make a request, email us at privacy@prevailprtnrs.com or call (216) 789-9639. We will verify your identity before responding, generally by confirming details you have already provided to us, and we will respond within the time required by applicable law. We will not discriminate against you for exercising these rights. You may also use an authorized agent to submit a request on your behalf, with proof of authorization.
8. Data Retention
We keep personal information for as long as needed for the purpose it was collected — typically for the duration of our relationship with you and for a period afterward to meet legal, tax, insurance, and recordkeeping obligations. Inquiry and marketing contact information is kept until you ask us to delete it or it is no longer useful. Transaction records are retained for at least seven years after a closing.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect the information we hold, including encrypted transmission, access controls, and vetted service providers. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please do not send highly sensitive information through unsecured email or web forms.
10. Third-Party Links
The Site may link to third-party websites, including our valuation tool, social media profiles, and resources we find useful. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing information.
11. Changes to This Policy
We may update this policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be noted on this page. Your continued use of the Site after an update means you accept the revised policy.
